1. Is the P.I. licensed in all jurisdictions in which the investigation will be conducted? Ask to see the license.
2. Is the agency the P.I. works for licensed in all jurisdictions in which the investigation will be conducted? Ask to see the license or get the license number and name of licensing authority(hint: in most states this number is required to be printed on forms and advertising media).
3. Is the P.I./Agency a member of any professional trade organizations? There are a number or reputable professional trade organizations in the P.I. profession, and membership in none of them should raise concerns.
4. Does the P.I./agency carry liability insurance or is bonded? Are all subcontracted Investigators(if any) covered?
5. Can the P.I./Agency provide professional references? Many clients of the P.I./agency are confidential but attorney or colleague references can certainly be asked for.
6. Will the P.I./Agency have a working retainer agreement with the scope of investigation and payment terms outlined?
7. Will the relationship between yourself and the P.I./Agency be bound by confidentiality? Is this agreement made in writing?
8. How often and in what form will I receive case updates?
9. What form of evidence will be obtained? How is it retained/disseminated? Is their a chain of custody procedure in place?
10. Do you require a summons/subpeona to testify in court?
